为明确甲方与乙方的权利义务，根据《中华人民共和国合同法》及相关法律法规的规定，经双方协商一致，达成协议如下：

第一条：租赁房屋及用途

甲方将坐落于 的房屋(毛坯房)租予乙方作为 居住 使用，面积为 平方米。

第二条：租赁期限

第三条：租金及保证金

第四条：双方权利与义务

(一)乙方对房屋进行装修时，自行负担装修押金及相关费用，并应严格遵守物业相关规定及要求。装修过程中造成自己或相关方损失的，责任自行承担。乙方装修后的附属物产权无偿归甲方所有，于租赁期满时完好交予甲方。

(二)租赁期内，房屋水电费、煤气费、电话费、物业管理费等费用均由乙方自行负担。如乙方不能按时缴纳造成甲方损失的，应当予以赔偿。

(三)租赁期限内，乙方应承担租赁房屋的修缮义务，并自行承担相关费用。同时，乙方应妥善使用、管理出租房屋的内外设备，未征得甲方同意，乙方不能擅自变更，损坏房屋结构和设备。

(四)乙方不得转租，并不得利用出租房屋进行非法活动或存放危险物品，影响公共安全。

(五)乙方需合理使用并爱护租赁房屋及相应设施，并应承担房屋及相应设备设施的日常维护、维修及相应费用。保证房屋及设备设施处于安全及可正常使用状态。乙方未按时按要求对房屋进行必要的修缮，造成自身和他人财务损失和人员伤害的，应承担赔偿义务。

(六)甲方应于合同生效当日将房屋交付给乙方使用。并保证对房屋拥有相应的处分权。

(七)租赁期满之日，在不续租情况下，乙方应无条件退租，并将房屋及附属物归还甲方，不得向甲方请求退还租金，搬迁费等费用。乙方应将自用家具物品搬迁清楚，不得故意留存占据，如逾期不搬视为乙方抛弃其所有权，由甲方自行处理。对逾期不迁出者，甲方可向人民法院提请诉讼，一切损失由乙方承担赔偿。

第五条：甲方与乙方的变更

(一)若甲方将房产所有权转移给第三方时，合同对新的房产所有者继续有效。

(二)甲方出卖房屋，须在一个月前通知乙方，在同等条件下乙方有优先购买权。

第六条：合同的解除

(一)租赁期间双方均不得无故解除合同，但乙方因特殊情况需退房时，必须提前一个月通知甲方，征得甲方同意，并支付一个月租金作为赔偿，且乙方不得向甲方索要任何装修补偿。如甲方确需收回房屋自用，也须提前一个月通知乙方，征得乙方同意，支付一个月租金作为乙方搬迁的补偿，并退还乙方未满租期的租金，还应按时间折现给乙方相应装修补偿。

(二)乙方有下列情形之一的，甲方有权终止合同，收回房屋：

1、乙方擅自将房屋转租，或转借他人使用的;

2、乙方利用承租房屋进行非法活动，损害公共利益的;

3、乙方逾期缴纳租金达一个月的;

第七条：续租

租赁期届满时，租赁关系自然终止，甲方无须另行通知乙方，若双方均有意续租，可在届满前一个月提出续租意向，并议定合理租金并签订续租合同。如逾期不提出，视为双方不再续租。

第八条：违约责任

(一)甲方违反本合同相关条款的约定的，应向乙方支付二个月的租金作为违约金。

(二)乙方违反本合同相关条款的约定的，应向甲方支付二个月的租金作为违约金;但乙方故意逾期未交付租金的，除支付违约金外还应及时如数补交租金，如遇特殊情况暂时未交租金的，甲，乙双方可协商解决。

第九条：免责条件

房屋如因不可抗力的原因导致损坏和造成损失的，双方互不承担责任。

第十条：争议的解决方式

本合同在履行中如发生争议，双方协商解决，协商不成时，双方均可向房屋所在地人民法院提起诉讼。

第十一条：合同生效

本合同一式二份，甲、乙双方各执一份。合同自双方签字之日起生效。

现经甲乙两方充分了解、协商，一致达成如下租房合同：

4、房屋只限乙方使用，乙方不得私自转租、改变使用性质或供非法用途。租下本房后，乙方应立即办好租赁登记、暂住人口登记等手续。若发生非法事件，乙方自负后果。在租赁期限内，甲方确需提前收回房屋时，应当事先商得乙方同意，给乙方造成损失的，应当予以赔偿。

5、合同一经签订，两方都不得提前解除。租赁期内，如遇不可抗力因素导致无法继续履行本合同的，本合同自然终止，两方互不承担违约责任。

6、甲乙两方约定，乙方如需开具房租发票，因此产生的税费由乙方支付。

7、本合同未尽事宜，两方可协商解决，并作出补充条款，补充条款与本合同有同等效力。两方如果出现纠纷，先友好协商，协商不成的，由人民法院裁定。

八、甲方的责任：

8.1 甲方须按时将出租房屋及其家私家具用品与其设施以良好状态交付乙方使用。

8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

九、乙方的责任：

party b’s obligations:

9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

party b shall promptly pay all rent ,security deposit and other charges payable by it in accordance with the terms of this agreement.

9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

9.3 乙方应按本合同的约定合法使用出租房屋，不得擅自改变使用性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

9.4 未经甲方事先书面同意，乙方不得将出租房屋转租或租给其他的第三者。

十、违约处理：

10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

c.无故拖欠租金超过三天(除双方就本合同存在争议除外)。

十一、适用法律：
